Please read these Terms and Conditions carefully before using The Daily Bread website or placing an order. These terms constitute a legally binding agreement between you and The Daily Bread (Pty) Ltd, registered in the Republic of South Africa.
1. Acceptance of Terms
By accessing or using The Daily Bread website (thedailybread.co.za) and placing orders through our platform, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services. We reserve the right to update these terms at any time, and your continued use of our services constitutes acceptance of any changes.
2. Products and Availability
All products displayed on our website are subject to availability. We bake fresh daily and some items may sell out. We reserve the right to withdraw or modify any product without notice. Product images are for illustrative purposes only; actual products may vary slightly in appearance. All prices are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable.
3. Ordering and Payment
Orders placed through our website are subject to acceptance by The Daily Bread. We reserve the right to refuse or cancel any order at our discretion. Payment must be made in full at the time of ordering. We accept major credit and debit cards processed securely through our payment provider. You warrant that you are authorised to use the payment method provided. Order confirmation will be sent to the email address provided at checkout.
4. Delivery Policy
We offer delivery within the Sandton area and surrounding suburbs. Delivery fees and estimated times are displayed at checkout. Delivery times are estimates only and may be affected by traffic, weather, or high demand. Free delivery is available on orders over R350 within the Sandton delivery zone. We are not liable for delays caused by circumstances beyond our control. You are responsible for ensuring someone is available to receive the delivery at the specified address.
5. Cancellations and Refunds
Orders may be cancelled within 30 minutes of placement for a full refund. After this window, cancellations are subject to a 50% cancellation fee as baking may have commenced. Custom orders require a non-refundable 50% deposit and cannot be cancelled within 48 hours of the scheduled collection or delivery date. Refunds for defective or incorrect products will be issued within 5–7 business days upon verification. We do not accept returns of food products for hygiene reasons unless the product is defective.
6. Custom Orders
Custom orders (including event catering, celebration cakes, and corporate boxes) are subject to a separate Custom Order Agreement. A 50% non-refundable deposit is required to confirm all custom orders. Final payment is due 48 hours before the collection or delivery date. We reserve the right to decline custom orders that we are unable to fulfil to our quality standards. Any dietary requirements or allergen information must be disclosed at the time of ordering.
7. Allergen Information
Our bakery handles wheat, gluten, dairy, eggs, nuts, and other common allergens. While we take precautions, we cannot guarantee that any product is completely free from allergens due to the risk of cross-contamination in our kitchen environment. Customers with severe allergies should contact us directly before placing an order. The Daily Bread accepts no liability for allergic reactions resulting from undisclosed allergen information.
8. Membership and Subscriptions
Membership plans are billed on a monthly basis and will automatically renew unless cancelled at least 5 business days before the next billing date. Members may cancel their subscription at any time through their account or by contacting us. No refunds are provided for partial months. Membership benefits are non-transferable and are subject to change with 30 days' notice. We reserve the right to terminate memberships that are used in violation of these terms.
9. Intellectual Property
All content on this website, including text, images, logos, and design, is the intellectual property of The Daily Bread and is protected by South African copyright law. You may not reproduce, distribute, or use any content from this website without our prior written consent. Our logo and brand name are registered trademarks and may not be used without permission.
10. Limitation of Liability
To the maximum extent permitted by law, The Daily Bread shall not be liable for any indirect, incidental, or consequential damages arising from your use of our website or services. Our total liability to you for any claim shall not exceed the value of the order giving rise to the claim. Nothing in these terms limits our liability for death, personal injury, or fraud caused by our negligence.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Johannesburg, Gauteng.
